Contract Terms And Conditions
Wayne Craft incorporated is a residential builder with licensed number 2102183122, underthe Occupational Code of 1980 state of Michigan. Wayne Craft carries general liability andworkers compensation insurance to protect owner and workmen while on the property.
Workmen will complete all phases of the Contracted project in a professional and timelymanner. Project Delays may occur such as in obtaining building permits, strikes, weather conditions, material shortages, delivery delays or other causes beyond Wayne Craft’s control. Wayne craft is not responsible for compensation of the owners as a result of time loss from employment or other activities related to the completion of the contracted workor warranty repairs.
Owners signing of this contract is authorization of Wayne Craft’s workmen to have access to property during daylight hours to complete contracted improvements or warranty repairs.
Wayne Craft to provide 18-month warranty on installation labor for items specified in the contract with exception of concrete. There is no warranty on concrete covering stresscracks, cracking, settling, frost movement or color. There is no warranty for damage such as chipping or cracking from drilling or fastening into concrete. All manufactured warranties apply and will be provided on request.
Wayne craft installation warranty does not cover labor for manufacturers warranties. No other warranties promised, expressed, or implied including any implied warranty of merchantability or fitness have been made to the owner except those which are set forth in this contract. Wayne Craft assumes no responsibility for damage to premises or materials located on the premises as well as the landscaping itself such as trees, shrubs, flowers or grass, which may occur during work being performed on property. Pets must be put in house or restrained while workmen are on property. Wayne craft is not responsible for pets which may be injured or escaped while workmen are on property.
Wayne Craft’s debris will be cleaned up and hauled away. Dirt evacuated on property remains the responsibility of the owners to dispose unless contracted for in the scope of work. Wayne Craft is not responsible for painting or staining of wood unless included in scope of work.
Concealed damage which is exposed by Wayne Craft after commencement of work such as rotten wood, asbestos, mold, etc. must be repaired to complete the contracted work.These items are considered extras. Wayne Craft is not responsible for existing code violations. Extras required that a work order be written and signed by owner and Wayne Craft. Owners to pay costs of additional work (extras) as follows pay 50% on signing and balance added to final bill, If the property is subject to other regulations that would affect the ability of the owners to install the material covered by this contract because of the deed restrictions, a home owners association, a historic District Commission’s or any other reasons, then the owner is solely responsible for notifying Wayne Craft of these restrictions and securing authorization or permission in writing assuring those regulations of restrictions have been satisfied. Additional items required by local building codes are up or updating original property not included in the contract and are extras.
